Mr John Farrow
To Mr Chas Thurston and Others In Trust for the Inhabitants of Stradbrook
Grant and Demise of the Right of supplying the Town Pump with Water from the Pond in the orchard of the Premises formerly Catchpole’s


This Indre made the 4th day of July 1818. Between Jno Farrow of Stradbrook in the County of Suffolk Miller of the one pt. and Chas Thurston and Simon Baldry Churchwardens and Wm. Girling and Jno Briant Overseers of the Poor of the parish of Stradbrook aforesd of the other part Whereas the sd Jno Farrow is standeth seized in fee simple of and in a certain message or on tenoment and herewith situate and being in Stradbrook aforsd abutting upon the churchyard there towards the South with all the outhouses edifices buildings yards gardens orchards lands and herewiths to the same belonging or in otherwise abataining which were late the inheritance of Edwd Catchpole and before that of James Girling and whereas the Parish officers of the sd Parish of Strabrook have with the consent of the sd John Farrow not only sunk a Well in the yard belonging to the aforesd Premises near to the fence separating the same from the Highway or Street there but also dug and laid a channel thereto from the pond in the orchard belonging to the said premises for the purpose of supplying the said Well with water, and have also erected and put down a pump to communicate with the sd Well on the side of the said highway or street next the said fence for the purpose of supplying the inhabitants of the sd parish of Stradbrook with water. And whereas the sd Jno Farrow as well so indence this consent as aforesd as for the purpose of securing to the sd inhabitants the free right and priviledge of drawing and taking water from the sd well by means of the sd pump standing upon of against the sd highway or street and of keeping the sd well supplied with water from the said pond by and through the channel made therefrom as aforesd have agreed to make a Grant thereof for the term of 500 years unto the sd Charles Thurston Simon Baldry William Girling and John Briant (they being the Churchwardens and overseers of the poor of the same parish for the current year) their Exors Admors or assigns In Trust for themselves and the other inhabitants of the said Parish. Now this Indenture witnesseth that in pursuance of such agreement and for carrying the same into legal effect and for and in consideration of the sum of sixteen shillings of current british money to the said Jn Farrow paid by the sd parties hereto of the second part at or immediately before the execution of these Presents (the receipt whereof is hereby acknowledged ) and also for and in consideration of the yearly Rent hereinafter reserved and made payable xxx the sd Jn Farrow hath granted bargained sold and demised And by these presents doth grant bargain sell and demise unto the sd Chas Thurston Simon Baldry, William Girling and Jno Briant their exors admor and assigns The free and unlimited use of the sd well together with the full and free right of supplying the same and the pump communicating therewith mentioned in the recital herein before contained with water from the pond in the orchard belonging to the aforesaid Premises of him the sd Jno Farrow by and through the present channel cut and made from the sd Pond into the sd well and the channel or pipes from the sd well to the pump Together with full free liberty of Ingreesses Egresses and regresses upon all nocxxsary occasions and at all seasonable times into out of upon and from the sd orchard yard and premises for the purpose of repairing amending or renewing the sd well and the channels communicating therewith from the sd Pond and pump respectively and of scowering and cleaning the sd pond doing or suffering to be done as little xxxxx or damage as may or can be , and repairing amending and making good all such breaches , harm and damage as shall or maybe occasioned thereby To have and to hold the sd rights and liberties herein before mentioned and hereby granted and demised or intended so to be unto the sd Chas Thurston Simon Baldry William Girling and John Briant their esors admors or afsigns from the 23rd day of March (being Easter Monday/ more last past for and during and unto the full end and term of five hundred years thence next ensuing and fully to be complete and ended In Trust for themselves and all other the Inhabitants of the parish of Stradbrook aforsd. Yeilding and paying therefore unto the sd John Farrow his heirs or afsigns on the Easter Monday in every year during the sd Term at or in the Church porch of Stradbrook aforesd the Rent or sum of sixteen shillings of current British money Provided and is hereby agreed and declared that in Case default should happen to be made of or in payment of the aforesd yearly rent of 16shillings for twenty days next after Easter Monday in any year then it shall and maybe lawful to and for the asaid John Farrow his heirs or assigns to stop up the Channels of Communication between the sd Pump Well and Pond respectively and to debar and exclude the inhabitants of the said Parish of Stradbrook from the rights and liberties hereby granted until the sd yearly Rent and all arrears thereof be paid And in case of nonpayment thereof for the space of nine calendar months next after the Easter Monday in any one year then it shall be lawful for the sd Jno Farrow his heirs or afsigns to make void and determine the Estate hereby and created any thing xxxxxxxxxxxxxxxxxxxxxx to the contrary notwithstanding And the sd Jno Farrow for himself his heirs and Exons Admons and afs. doth hereby grant and agree that he the sd Jno Farrow his heirs or assigns shall not will at any time during the continuance of the afore sd term of five hundred years wilfully injure the said will of the channels of communication therewith reduce the sd pond nor so any wilful Act to let out or direct the water from supplying the sd pumpand well(save and except for xxxxxxxxxxx/ nor erect any necessary house, nor make any sewer or drain into the said pond, nor do any other wilful act whereby or by means whereof the water in the sd Pond shall xxxxxxxx be polluted and rendered unwholesome or unfit for use. In witness where of the sd Parties to these presents have hereto set their hands and seals the day and year first above written.
